1. Agreement to Terms

These Terms constitute a legally binding agreement between you ("Customer," "you," or "your") and AeroGuide Services ("Company," "we," "us," or "our"), an independent travel assistance provider based in the United States.

2. Description of Services

AeroGuide Services provides independent third-party assistance to travelers, including but not limited to:

• Assistance with flight booking date and time changes
• Passenger name correction requests
• Flight cancellation processing
• Refund claim submission and follow-up
• Baggage issue reporting and follow-up
• Seat assignment and upgrade requests

3. Independent Service Provider

AeroGuide Services operates as an entirely independent company. We have no affiliation, partnership, sponsorship, or endorsement relationship with any airline. Airline names referenced on our website are used for identification purposes only and remain the trademarks of their respective owners.

By using our services, you acknowledge and understand that:

• We are not an airline or airline representative
• We cannot guarantee outcomes that are ultimately controlled by airlines
• Our service fee is separate from any fees charged by the airline
• You retain the right to contact your airline directly at no cost to you

4. Service Fees

We charge a flat service fee for each assistance case. Our fee structure is as follows:

• All applicable service fees will be disclosed to you clearly and transparently before you agree to proceed with our service.
• You will not be charged without your explicit agreement to the quoted fee.
• Our service fee is separate from and in addition to any fees charged directly by the airline (e.g. change fees, cancellation fees).
• Airline-imposed fees are the customer's responsibility and are not included in our service fee.

By proceeding with our service after fee disclosure, you authorize us to charge the agreed service fee.

5. No Guarantee of Outcome

While we make every effort to assist you effectively, we cannot guarantee specific results. Outcomes such as refund approvals, change approvals, or cancellation terms are determined entirely at the discretion of the airline and subject to the airline's fare rules and policies.

You acknowledge that:

• Some airline policies may not permit changes, cancellations, or refunds
• Refund timelines are controlled by the airline and may vary
• We are not liable for outcomes decided by the airline

6. Refund Policy for Our Service Fee

Our service fee covers the time and expertise of our travel assistance specialists. The following refund terms apply to our service fee (not to airline refunds):

• Full refund: If we are unable to submit your request due to an error on our part, you are entitled to a full refund of our service fee.
• Partial refund: If work has been initiated but the case has not been fully processed, a partial refund may be considered at our discretion.
• No refund: If our assistance has been fully provided (i.e., the request was submitted to the airline on your behalf), no refund of the service fee will be issued regardless of the airline's decision.

7. Customer Responsibilities

You agree to:

• Provide accurate and complete information about your booking and travel details
• Ensure you are the authorized passenger or have authority to act on behalf of the passenger(s) in the booking
• Not use our services for fraudulent, unlawful, or unauthorized purposes
• Not misrepresent your identity or booking information
• Respond promptly to any requests for additional information needed to complete your case

8. Limitation of Liability

To the fullest extent permitted by applicable law, AeroGuide Services shall not be liable for:

• Any decisions made by airlines regarding your booking, refund, or change request
• Airline-imposed fees, penalties, or fare differences
• Delays in airline processing or refund timelines
• Any indirect, incidental, special, consequential, or punitive damages
• Loss of travel opportunities, accommodation costs, or other expenses arising from airline decisions

Our maximum liability to you for any claim arising from our services shall not exceed the service fee you paid to us for the specific case in question.

9. Privacy & Data Use

Your use of our services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our services, you consent to our collection and use of your personal information as described in our Privacy Policy.

10. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms or your use of our services shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration in accordance with applicable US arbitration rules.

For Canadian customers, applicable consumer protection laws in your province of residence shall also apply.

11. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to our website with a revised "Last Updated" date. Your continued use of our services after any changes constitutes your acceptance of the updated Terms. We encourage you to review these Terms periodically.

12. Severability

If any provision of these Terms is found to be invalid or unenforceable under applicable law, the remaining provisions shall continue in full force and effect.

13. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and AeroGuide Services with respect to your use of our services and supersede all prior agreements and understandings.
